ATOL protection for UK package holidays guarantees a cash refund or repatriation if your travel company collapses. This guide explains which bookings qualify, how to make a claim, and what ATOL does not cover, including flights sold separately.

What Is ATOL Protection for UK Package Holidays?

ATOL protection for UK package holidays is a statutory financial safety net administered by the Civil Aviation Authority (CAA). The Air Travel Organiser's Licence scheme requires travel companies selling flight-inclusive packages to UK consumers to hold an ATOL licence and contribute to the Air Travel Trust Fund. If the company fails, ATOL pays for repatriation if you are abroad and issues refunds if you have not yet travelled.

Critical rule: ATOL covers flight-inclusive packages, not standalone flights. A flight booked directly with an airline or through a non-ATOL agent is not covered. If your airline collapses, ATOL does not apply unless the flight was part of a qualifying package.

What ATOL Protection Covers

  • Flight-inclusive packages: holidays that include at least a flight plus hotel (or car hire, or another travel service) sold as a package by a single trader.

  • Flight-only sold by ATOL holders: some ATOL licences cover standalone flights sold by tour operators through their own platforms.

  • Repatriation: if you are already abroad when the company collapses, ATOL arranges flights home at no cost to you.

  • Cash refund: if you have not yet departed, ATOL refunds the full amount paid to the collapsed company.

  • Linked travel arrangements (LTAs): since 2018, some LTAs (where services were linked at point of sale) may qualify depending on how they were sold.

What ATOL Does Not Cover

  • Standalone flight tickets bought directly from an airline or through a non-ATOL agent.

  • Accommodation-only or car hire without a flight element.

  • Airline insolvency separately from a package: if the airline collapses but you booked the hotel separately, ATOL does not cover the hotel.

  • Non-UK travel companies: ATOL is a UK-specific scheme. EU package travel is covered under separate national implementations of the Package Travel Directive.

  • Business class or premium upgrades purchased as add-ons: the upgrade itself may not be refunded through ATOL.

How to Make an ATOL Claim

    Check your ATOL certificate: every ATOL-protected booking must include an ATOL certificate issued at the time of booking. This document confirms your protection and lists the booking reference.

    Visit the CAA's ATOL claims page: the CAA publishes a dedicated claim form at caa.co.uk when a company fails. This opens immediately after an insolvency announcement.

    Submit the claim form online: you will need the ATOL certificate number, booking reference, and proof of payment.

    Attach all receipts: credit card statements, booking confirmations, and any correspondence with the travel company.

    Await processing: standard claims are processed within 28 days. Complex claims involving ongoing trips may take longer.

    Receive payment: ATOL pays directly into your bank account. Repatriation flights are arranged separately if you are stranded.

Speed matters: file your ATOL claim as soon as the insolvency is announced. The CAA closes the claim window 12 months after the company's failure date.

ATOL vs. Credit Card Chargeback

ATOL and a credit card chargeback are both available when a travel company collapses. You should use ATOL first if your booking is covered. If ATOL pays you, you have received full recovery and the chargeback is not needed. If ATOL only partially covers your loss (for example, because part of the booking was not ATOL-protected), pursue a chargeback for the uncovered portion.

ATOL and the 2018 Package Travel Regulations

The UK's Package Travel and Linked Travel Arrangements Regulations 2018 broadened protection beyond traditional packages to include dynamically packaged trips where services are linked at the point of sale. This means some online booking combinations that would not have been covered before 2018 may now qualify for ATOL protection.

The Civil Aviation Authority's ATOL guidance is the authoritative source for checking whether a specific booking type is covered. When in doubt, ask the travel company for their ATOL licence number before booking.

What Happens If Your Airline Collapses Mid-Package

If your airline collapses while you are on holiday and it is part of an ATOL-protected package, the ATOL holder (your tour operator) must either arrange alternative flights or pay your repatriation costs through the Air Travel Trust Fund. You do not need to buy a new ticket out of your own pocket.

If the airline collapse affects only part of your itinerary (for example, the return leg), contact the ATOL holder immediately. They are obligated under the 2018 Regulations to provide replacement transport of equivalent quality. Checking If Your Booking Is ATOL Protected

Look for three things: the ATOL logo on the company's website and booking confirmation, an ATOL certificate emailed to you within 24 hours of booking, and the ATOL licence number (a 4-5 digit number you can verify on the CAA's website). If any of these are missing, your booking may not be protected.
