Boston Dublin Flight Cancelled: EU261 Framework

Boston Dublin flight cancelled compensation under EU261 applies when Aer Lingus operates the route, since Aer Lingus is an EU-licensed Irish carrier. EU261 covers both the BOS-DUB outbound and the DUB-BOS return on Aer Lingus. On American Airlines (US-licensed), EU261 applies only on the DUB-BOS leg departing Dublin Airport (EU airport). The route is approximately 5,100 km, placing it in EU261's top band. Dublin is in the Republic of Ireland, which is an EU member state. UK261 does not apply because Dublin is not in the UK. Note: Shannon (SNN) and Cork (ORK) also serve the US-Ireland transatlantic market. The same EU261 framework applies: Aer Lingus on both legs, American on Irish-departure legs only. EU airport departure always triggers EU261 regardless of carrier.

Aer Lingus vs American Airlines: Eligibility on BOS-DUB

  • Aer Lingus (EI): EU-licensed Irish carrier. EU261 on BOTH BOS-DUB and DUB-BOS legs. EUR 600 per passenger.

  • American Airlines (AA): US-licensed. EU261 ONLY on DUB-BOS (departing Dublin EU airport). BOS-DUB outbound is US DOT only.

  • Aer Lingus Regional (Emerald Airlines-operated): These are shorter Irish domestic/UK routes, not transatlantic. EU261 still applies (EU-licensed, EU airport).

  • Connecting via LHR (British Airways or Aer Lingus): LHR is a UK airport (UK261 territory, not EU261 after Brexit). BOS-LHR-DUB on British Airways triggers UK261 on the LHR-BOS return, not EU261.

  • Single-ticket through connection: If BOS-DUB is on a single Aer Lingus ticket with an onward DUB-LHR segment, EU261 covers the BOS-DUB delay and its downstream impact.

EU261 Compensation for BOS-DUB Cancellations

  • Flight cancelled and you decline rebooking: EUR 600 per passenger plus full ticket refund.

  • Cancellation with rerouting causing 4+ hour delay at DUB: EUR 600 per passenger.

  • 3+ hour delay at destination (not cancellation): EUR 600 per passenger.

  • Less than 14 days notice of cancellation: EUR 600 applies. Exceptions: earlier notice with rebooking within specific time windows reduces to EUR 300 or EUR 150.

  • More than 14 days notice: No monetary compensation (adequate notice). Refund still required if you decline.

Pre-Clearance at Dublin Airport and EU261

Dublin Airport has a unique US Customs and Border Protection pre-clearance facility. Passengers clear US customs in Dublin before boarding, which is unusual for EU airports. This does not affect EU261 eligibility. Aer Lingus DUB-BOS departures are still from an EU airport (Dublin), and EU261 applies normally. The pre-clearance facility is an operational feature, not a legal reclassification of the airport.

  • Pre-clearance delay: If pre-clearance process causes delay, document separately. The carrier is responsible for departure, not CBP pre-clearance timing.

  • Shannon pre-clearance: Shannon Airport also has US pre-clearance. Same EU261 rules apply on SNN departures.

  • EU261 trigger: Still the departure from the EU airport (DUB or SNN), not the arrival in the US.

Common Causes of BOS-DUB Disruptions

  • Dublin weather (October-March): Atlantic storms, wind, and rain affect DUB regularly. Irish courts and the Irish Aviation Authority (IAA) have generally NOT found routine Irish weather to be extraordinary for Aer Lingus.

  • BOS winter weather: Boston nor'easters and winter storms are foreseeable. US DOT perspective: not relevant to EU261 eligibility. Irish courts: typically not extraordinary for Aer Lingus' operational planning.

  • Aer Lingus technical issues: Aircraft technical issues within Aer Lingus' maintenance are not extraordinary.

  • Genuine extraordinary: Volcanic ash (Iceland eruptions affect North Atlantic routes), terrorism security events, government-ordered grounding.

  • ATC strikes: European ATC strikes can qualify. Irish ATC strikes historically treated as not extraordinary by Irish courts since they are foreseeable as labor actions.

How to File an EU261 Claim for BOS-DUB from the US

    Confirm operating carrier: Aer Lingus or American Airlines on your boarding pass.

    Confirm EU261 eligibility: Aer Lingus on both legs; American only on DUB-BOS.

    Document: boarding pass, Aer Lingus cancellation notification, FIDS screenshot, meal and hotel receipts.

UK261 vs EU261: Not Applicable Here

UK261 (the UK's post-Brexit retention of EU261 rules) applies on flights departing UK airports (LHR, LGW, MAN, EDI, etc.) and on UK-licensed carriers. Dublin Airport is in Ireland (EU), not the UK. Aer Lingus is an Irish carrier, not a UK-licensed carrier. Therefore, UK261 does not apply on the BOS-DUB route. EU261 is the correct framework. This distinction matters if you are connecting: BOS-LHR-DUB on British Airways involves UK261 on the return LHR-BOS leg, not EU261.
