Hong Kong Airport Delay: CASL Passenger Rights at HKG

Hong Kong International Airport (HKG) handles over 70 million passengers annually and is the primary hub for Cathay Pacific (CX) and Hong Kong Airlines (HX). Important context: Hong Kong operates under a 'one country, two systems' framework. Hong Kong aviation law is distinct from mainland Chinese aviation regulations. Hong Kong is not subject to EU261, but some EU-licensed carrier flights from HKG are.

Hong Kong CAD: What Airlines Must Provide at HKG

Hong Kong does not have legislation equivalent to EU261 providing fixed cash compensation for delays. Passenger rights at HKG are primarily governed by:

  • Airline Conditions of Carriage: Each carrier's standard terms define its care obligations. Cathay Pacific and Hong Kong Airlines publish Conditions of Carriage that include delay care provisions.

  • CAD Guidelines: CAD issues guidelines to airlines on passenger care standards, including information, meals, and accommodation for significant delays.

  • Montreal Convention: For international flights, the Convention sets liability limits for delayed and damaged baggage.

  • Consumer protection laws: Hong Kong's Trade Descriptions Ordinance and general consumer protection law apply to airline commercial practices.

In practice, CAD guidelines require airlines to provide information, meals, and accommodation for significant delays. The thresholds are not fixed in legislation with the precision of EU261 but are applied through guidelines and airline Conditions of Carriage.

Cathay Pacific Delay Policy at HKG

Cathay Pacific (CX), as the dominant carrier at HKG, has detailed passenger care commitments:

  • Delays of 2 hours or more (controllable): Cathay provides meal vouchers at HKG for controllable delays.

  • Delays of 5 hours or more: Cathay offers rebooking on the next available Cathay or partner flight, or a full refund.

  • Overnight controllable delays: Hotel accommodation and ground transport.

  • Weather and ATC delays: Classified as extraordinary circumstances. Meal provision continues, but hotel is less certain.

  • Marco Polo Club and Asia Miles elite members: Priority rebooking and dedicated service desks during irregular operations.

Cathay Pacific is a oneworld alliance member, which provides some rebooking options on oneworld partner airlines for significant disruptions on single-booking itineraries.

When EU261 or UK261 Applies at HKG

EU261 applies at HKG for flights operated by EU-licensed carriers to EU destinations:

  • Lufthansa HKG to Frankfurt: EU261 applies.

  • Air France HKG to Paris: EU261 applies.

  • British Airways HKG to London: UK261 applies.

  • Cathay Pacific HKG to Amsterdam: EU261 does NOT apply. CX is HK-licensed.

  • Emirates HKG to Frankfurt: EU261 does NOT apply. Emirates is UAE-licensed.

DOT Refund Rights for US-Bound HKG Flights
