Mexico City Airport Delay: COFECE Rules and Passenger Rights at MEX

Passenger Rights at Mexico City Airport (MEX): The Framework

Benito Juarez International Airport (MEX) is Mexico's primary aviation hub and Latin America's busiest airport. When flights are delayed at MEX, Mexico's Ley de Aviación Civil (LAC) applies, specifically Article 47 Bis on passenger rights. This is the same national framework that applies at all Mexican airports, including the new Felipe Angeles International Airport (NLU) and Cancun (CUN). Key right: Flights delayed more than 4 hours or cancelled entitle you to 25% of the ticket price as monetary compensation PLUS care (meals, hotel) and a rebooking or refund. This is a legal entitlement, not a goodwill gesture.

MEX has historically suffered from significant congestion and slot restrictions, making delays a common occurrence. Article 47 Bis: Your Rights at MEX Step by Step

Mexico's Aeronautical Law establishes rights based on delay duration:

  • Delay of 1 hour or more: Free phone or internet access.

  • Delay of 2 hours or more: Meals and beverages proportionate to the wait.

  • Delay of 4 hours or more OR cancellation: Hotel and ground transport if an overnight stay is required, plus either a rebooking on the next available flight or a full refund. Also triggers the 25% monetary compensation right.

  • Denied boarding: Same as cancellation rights, plus priority rebooking.

The 25% monetary compensation is calculated on the price paid for the affected segment. For a 2,500 MXN domestic MEX to Guadalajara ticket, that is 625 MXN. For an international MEX to Madrid ticket at $800, that is $200. These amounts are in addition to care and rebooking rights.

Major Carriers at MEX: Aeromexico, Volaris, Vivaaerobus

The dominant carriers at MEX and their delay handling:

  • Aeromexico (AM): Mexico's flag carrier and largest at MEX. Provides meal vouchers at dedicated customer service desks in both the national and international terminals. SkyTeam alliance membership provides some international rebooking options.

  • Volaris (Y4): Low-cost carrier with a significant domestic presence at MEX. Rights apply under LAC, though proactive communication during delays has been a consistent weakness.

  • Vivaaerobus (VB): Ultra-low-cost carrier. LAC minimums apply. Request care explicitly at the check-in or gate desk.

  • International carriers at MEX: American, United, Delta, Iberia, Air France, KLM, and others operate at MEX. For EU-licensed carriers on EU-bound routes, EU261 applies.

When EU261 Applies at MEX

EU261 applies at MEX in the same way as at CUN: when the operating carrier is EU-licensed and the flight is bound for an EU destination.

  • Iberia MEX to Madrid: EU261 applies. Iberia is EU-licensed (Spain).

  • Air France MEX to Paris: EU261 applies. Air France is EU-licensed (France).

  • KLM MEX to Amsterdam: EU261 applies.

  • Aeromexico MEX to Madrid: EU261 does NOT apply. Aeromexico is Mexican-licensed.

DOT Rights for US-Bound Flights from MEX

For flights from MEX to the US, US DOT rules apply in addition to Mexican LAC. The DOT October 2024 final rule entitles you to a full cash refund for international delays of 6 or more hours if you choose not to travel. This applies to Aeromexico, American, United, and Delta on MEX to US routes.

PROFECO Complaints for MEX Delays

PROFECO is the primary enforcement authority for passenger rights violations at MEX:

    File a written complaint with the airline first. Most airlines have customer service desks in the MEX national and international terminals.

    If the airline does not respond within 30 days or rejects your claim, file with PROFECO at profeco.gob.mx.

    Include your flight details, booking confirmation, evidence of the delay, correspondence with the airline, and documentation of the remedy you are seeking.

    PROFECO will contact the airline and attempt conciliation. Airlines that fail to comply with LAC rights can face administrative penalties.

Practical Tips at MEX During a Delay

MEX is a large, congested airport with separate national and international terminals. During a delay:

  • For Aeromexico at MEX, the dedicated customer service desks are in Terminal 2. Volaris and most low-cost carriers operate from Terminal 1.

  • Request meal vouchers explicitly at the 2-hour mark. Do not assume they will be offered proactively.

  • Ask for a written delay confirmation from the airline. This is essential for both LAC compensation claims and credit card benefit claims.

  • Keep all receipts for expenses not covered by vouchers.
