Seattle to Tokyo Delay: Does EU261 Apply on Japan Airlines?

EU261 covers (1) all carriers departing EU airports, and (2) EU-licensed carriers on flights arriving in the EU. Japan Airlines (JAL) is a Japanese carrier, not EU-licensed. Seattle-Tacoma International (SEA) is not an EU airport. Tokyo Narita (NRT) and Haneda (HND) are not EU airports. No leg of a SEA-NRT itinerary falls under EU261. The applicable frameworks are US DOT 14 CFR Part 260 and Japanese aviation passenger rights.

  • United Airlines: US carrier. Only US DOT rules apply. No Japanese passenger rights framework extends to United.

  • Delta Air Lines (via SEA hub): US carrier. US DOT only.

  • Ana (All Nippon Airways): Japanese carrier. Both US DOT (on US operations) and Japanese MLIT rules may apply.

US DOT Rights on SEA-NRT

US DOT 14 CFR Part 260 provides clear cash refund rights on SEA-NRT regardless of carrier (JAL, United, Delta, ANA):

  • Cancellation: Any cause. Cash refund to original payment when you decline rebooking.

  • 6+ hour international delay: SEA-NRT is international. 6-hour significant delay threshold triggers refund right when you decline rebooking.

  • Class downgrade: Refund of fare difference if moved from Business/First to Economy.

  • Significant schedule change pre-departure: If JAL or United changes your departure significantly and you do not accept.

  • Credit card refund deadline: 7 business days.

  • Cash/check refund deadline: 20 calendar days.

Japanese Passenger Rights on JAL and ANA

  • Cancellation refund: JAL and ANA must refund the ticket when they cancel. Refund policy aligns with Japanese Civil Aeronautics Act standards.

  • Delay compensation: Japan does not have a fixed cash compensation framework equivalent to EU261. Compensation is at carrier discretion or through the carrier's customer relations process.

  • JAL Care Kit: Japan Airlines provides voluntary amenity kits and meal vouchers for delays, but these are goodwill, not mandatory fixed compensation.

  • MLIT complaint: Japan's Ministry of Land, Infrastructure, Transport and Tourism handles complaints against Japanese carriers. The process is slower than DOT and typically does not yield fixed compensation payments.

  • Mileage compensation: JAL and ANA often offer frequent flyer miles as goodwill for delays. Evaluate these against the cash value as with any miles offer.

Common SEA-NRT Delay Causes

  • Seattle winter weather: Pacific Northwest winter storms and occasional snow events at SEA. Foreseeable for carriers operating the route.

  • NRT typhoon season (June-October): Typhoons affecting the Tokyo area cause significant delays and occasional cancellations. Major typhoons are genuine extraordinary circumstances for EU261 purposes, though EU261 does not apply here.

  • North Pacific oceanic routing: Jet stream variations and occasional air traffic management restrictions on North Pacific tracks.

  • JAL and ANA technical issues: Both carriers have strong maintenance records. Technical delays are relatively rare.

  • NRT/HND ATC restrictions: Tokyo airspace management occasionally restricts departures. Generally not extraordinary under US DOT framework.

If Your SEA-NRT Route Connects via an EU Airport

Some SEA-Tokyo itineraries route via European airports (London LHR, Frankfurt FRA, Amsterdam AMS). In those cases, EU261 or UK261 may apply:

  • SEA-LHR-NRT on British Airways: UK261 applies on the LHR-NRT and NRT-LHR legs (departing UK airport or UK-licensed carrier). EU261 does not apply since LHR is in the UK post-Brexit.

  • SEA-FRA-NRT on Lufthansa: EU261 applies on both FRA-NRT legs (EU-licensed carrier) and the FRA-SEA return (departing EU airport).

  • SEA-AMS-NRT on KLM: EU261 applies on both AMS-NRT legs (EU-licensed carrier) and AMS-SEA return.

  • All-Japan metal (SEA-NRT direct on JAL or ANA): No EU261. US DOT only.
