Filing Instructions
Go to your county small claims court by searching '[your county] small claims court filing'. Filing fees are typically $30 to $100 depending on the amount of your claim and the state. Complete the court's standard small claims form and attach this statement. You must serve the airline's registered agent with the court papers. Ask the clerk for instructions on service of process for out-of-state corporations. Most courts allow service by certified mail.
You do not need a lawyer. Small claims courts are designed for self-represented parties. Bring your documents organized chronologically in a folder, and arrive 15 minutes early on your court date.
What to Expect on Your Court Date
Airlines often send a non-lawyer representative (a paralegal or customer service coordinator) or do not appear at all. If the airline does not appear, you receive a default judgment. Present your case clearly and briefly: what you paid, what the airline failed to do, what federal regulation requires them to refund you, and what documentation you have.
Judges appreciate brevity and organization. Your statement structure (legal basis, amount, evidence) matches what judges look for. Do not editorialize. State the facts, cite the regulation, and request the specific dollar amount.
