Tarmac Delay Rules: What Airlines Must Do After 3 Hours
When your plane sits on the tarmac for hours, federal rules protect you. Airlines face fines of up to $27,500 per passenger for violations. Here is what airlines must do, when you can demand to deplane, and how to file a complaint if they break the rules.
The 3-Hour Rule
Under DOT tarmac delay rules, airlines operating domestic flights must offer passengers the opportunity to deplane after 3 hours on the tarmac. For international flights, the limit is 4 hours. The clock starts when the aircraft door closes at departure or when the aircraft lands at arrival.
Airlines face fines of up to $27,500 per passenger for tarmac delay violations. This penalty is per passenger, not per flight, which creates enormous financial exposure for airlines. This is why most airlines now take tarmac delays seriously.
Requirements During the Delay
Even before the 3-hour mark, airlines have specific obligations during tarmac delays.

Food and water: Must be provided within 2 hours of the delay beginning.

Lavatories: Working lavatories must remain available throughout the delay.

Updates: The airline must provide updates every 30 minutes about the status of the delay.

Medical assistance: Medical attention must be available if needed.

Exceptions to the Rule
The tarmac delay rule has narrow exceptions. The captain or air traffic control can determine that deplaning would jeopardize safety or security. The airline can also delay deplaning if returning to the gate would significantly disrupt airport operations. However, these exceptions are not blanket excuses, and the DOT scrutinizes them closely.

Note the exact time the aircraft door closed. This starts your clock.

Screenshot delay announcements and note the timestamp of each crew update.

Track food and water: Note when (or if) they were offered.

At the 3-hour mark, note whether the airline announced a deplaning opportunity.

After the flight, file a complaint at transportation.gov/airconsumer if any rules were violated.

Refund Rights After a Tarmac Delay
If the tarmac delay results in a total departure delay of 3 or more hours domestic (or 6 hours international), you are entitled to a full cash refund if you choose not to travel.
