Traveling with a Baby: What You're Owed When Flights Go Wrong

Baby infant flight delay compensation rights cover both the parent's compensation and the airline's specific duties for infant care: bassinets, formula, diapers, age-appropriate accommodations. Lap children have no separate cash compensation but extensive care duties. Children with their own ticket have full per-passenger compensation rights.

Baby Infant Flight Delay Compensation: Lap Child vs Ticketed Infant

Baby infant flight delay compensation rights split sharply by ticketing status. A lap child (under 2 on US domestic, often under 2 on international with discounted infant fare) has no separate cash compensation right. The lap child travels under the parent's ticket and the parent's compensation includes the lap child by default. A ticketed infant (with their own seat, even if infant fare) has full per-passenger compensation rights identical to an adult: cash refund for cancellation, EU261 cash compensation for EU-covered delays, Montreal Convention documented loss recovery. The key distinction: separate ticket equals separate compensation.

Separate ticket = separate compensation. Lap child = parent's compensation. This is the foundational rule for infant flight delay claims.

Lap Child Care Duties During a Disruption

  • Bassinet provision: pre-booked bassinets must be provided on the rebook flight where available.

  • Infant meals: age-appropriate food during meal service and during extended waits.

  • Formula and diapers: airline duty under EU261 Article 9 and most US carrier customer service plans.

  • Bottle warming: cabin crew obligation on most carriers.

  • Hotel accommodation with crib: family rooms with infant amenities for overnight stranding.

  • Priority rebook for parent and infant: airlines typically prioritise parents with young children.

Ticketed Infant Compensation

An infant with their own ticket (separate seat, even if discounted infant fare) is a full passenger under the compensation frameworks. US DOT refund rule covers the infant ticket value. EU261 cash compensation applies at the same EUR 250 to 600 amount as an adult. Montreal Convention documented loss recovery is independent. The compensation is paid to the parent or legal guardian as the infant's representative. For families considering whether to buy a separate infant ticket on long international flights, the compensation right is one consideration in addition to the safety and comfort benefits of having a separate seat.

Stroller and Car Seat Damage Claims

Strollers and car seats checked at the gate or with checked baggage are covered under Montreal Convention baggage liability (1,288 SDR per passenger, about USD 1,500). A damaged stroller or car seat is a baggage claim. Document the damage immediately upon arrival, file the airline's damage report at the baggage office before leaving the airport, and submit photos and receipts. Airline customer service plans typically commit to repair or replacement within set timelines. See airline damaged your stroller: baby gear claim and stroller and car seat damaged claim walkthrough.

EU261 and Infant Care

EU Regulation 261/2004 Article 9 duty of care includes meals and refreshments 'proportionate to the waiting time' and overnight accommodation when needed. The 'proportionate' standard includes age-appropriate provisions: formula, baby food, diapers, infant supplies. EU regulators have interpreted Article 9 broadly for families. Airlines that fail to provide infant supplies during an extended delay are violating duty of care obligations. See EU261 explained: complete guide and pregnant passenger denied boarding: your rights.

ACAA and Infant Accessibility

The Air Carrier Access Act (ACAA) provides accessibility protections for passengers with disabilities, but pregnant passengers and parents travelling with very young infants sometimes have additional accommodations. Family priority rebook, family-friendly rebook flight selection, and accessible boarding are typical. For passengers with newborns or premature infants requiring medical accommodations, the ACAA framework can provide additional protections. See ACAA rights for US passengers with disabilities, pregnant passenger with medical needs: rights, and CPAP and medical device handling on flights.

How to Claim Infant-Related Compensation

  1. 1

Confirm whether the infant has a separate ticket (full compensation rights) or is a lap child (parent's compensation includes them).

  2. 2

For ticketed infants: file the same refund request as for any passenger, citing the 2024 DOT rule or EU261.

  3. 3

For lap children: claim the parent's compensation; document any infant-specific care duty failures (no bassinet, no formula, no infant supplies).

  4. 4

For damaged strollers or car seats: file an airline baggage damage report at the airport immediately. Submit photos and replacement cost receipts.

  5. 5

For overnight stranding: ensure family room with infant amenities. Document if denied.

  6. 6

For EU-departing flights: claim EU261 per ticketed passenger. For Article 9 duty of care violations: file with the national enforcement body.

Decision Framework: Infant Travel Recovery

  1. 1

Was the infant ticketed (separate seat)? If yes: full per-passenger compensation right.

  2. 2

Was the infant a lap child? If yes: parent's compensation includes them. No separate cash claim.

  3. 3

Did the airline fail care duties (no bassinet, no infant supplies, no age-appropriate meals)? File a complaint citing customer service plan or EU261 Article 9.

  4. 4

Was a stroller or car seat damaged? File a Montreal Convention baggage claim.

  5. 5

For overnight stranding: ensure family-appropriate accommodation.

  6. 6

Stack: parent's compensation + infant's compensation (if ticketed) + baggage claim (if damaged) + duty of care + travel insurance for prepaid trip elements.
