United Airlines Flight Delay Compensation: The Full Picture
United Airlines flight delay compensation is governed by at least three separate legal frameworks depending on your route, the delay length, and whether the airline offered an alternative. The 2024 DOT refund rule requires United to pay a cash refund for any cancellation or significant delay (3+ hours domestic, 6+ hours international) where you did not accept a rebooking or alternative. EU261/2004 applies to any United flight departing an EU airport or arriving in the EU on a United-operated ticket. The Montreal Convention Article 19 covers documented out-of-pocket losses on international routes up to roughly $7,300 per passenger. Most passengers at the gate take a voucher or travel credit because United's agents offer those first and prominently. What United Owes Under DOT Rules
The DOT final rule on refunds that took effect October 28, 2024 is the clearest protection US domestic fliers have. Under the rule, United must provide a cash refund (or original payment-method refund) when: (1) United cancels the flight for any reason; (2) a domestic flight departs or arrives 3 or more hours late; (3) an international flight departs or arrives 6 or more hours late; (4) the departure or arrival airport changes; or (5) the class of service is downgraded. United has 7 business days to process refunds for credit card purchases and 20 calendar days for other methods. The rule covers all tickets, including basic economy and non-refundable fares, when United causes the qualifying disruption. United cannot substitute a travel credit for this cash right without the passenger's affirmative, informed consent.
The DOT rule applies to all ticket types, including basic economy. Fare class does not reduce the refund right.
United's own Customer Commitment page describes some of these protections, but understates the legal obligation. United offers meal vouchers (typically $10 to $20) for delays over 3 hours and hotel accommodations for overnight delays caused by United-controllable events. Those duty-of-care measures do not satisfy the cash refund right on a cancelled or significantly delayed ticket. They are separate obligations.
Significant Delay: What the 3-Hour Threshold Means
The DOT rule defines a 'significant delay' for domestic flights as 3 or more hours measured from the scheduled departure or arrival time. For international routes, the threshold is 6 hours. United often characterizes delays below 3 hours as minor and offers nothing proactively. If your domestic United flight departs 2 hours 59 minutes late, no cash refund right is triggered under DOT (though duty of care and Montreal Convention Article 19 may still apply if the delay was on an international itinerary). The 3-hour threshold is measured gate-to-gate on the delayed segment, not from the time you originally checked in. A delay that crosses midnight counts once per segment, not cumulatively across an itinerary. If you miss a connection because United delayed your first segment by 90 minutes, and you ultimately arrive at your destination 4 hours late, that triggers the domestic refund right even if no single segment was delayed 3 hours independently, because your arrival is 3+ hours delayed overall.
Missed connection causing 3+ hour late arrival counts as a significant delay. United cannot escape the refund right by pointing to the individual segment times.
United Cancellation Refund Rights
When United cancels your flight, you are entitled to a full cash refund of the ticket price, all government taxes and fees, and any ancillary fees paid (seat upgrades, checked bags, change fees on a prior rebooking). United cannot substitute future travel credits for this refund without your explicit opt-in. The process: request the refund at the gate, at the airport service desk, or through United's refund request form online. If United's agent offers a rebooking on a comparable United or Star Alliance flight, you are not required to accept it. You may decline the rebooking and take the cash refund. If you accept the rebooking and then the rebooked flight is also cancelled or significantly delayed, your refund right resets on the rebooked segment. EU261 on United Transatlantic Flights
EU Regulation 261/2004 applies to United flights departing from any EU member state airport, regardless of whether United is an EU carrier. If you're flying United from Frankfurt, Amsterdam, London Heathrow (UK261 applies here, not EU261), Paris, Madrid, or any other EU departure airport and your flight is cancelled, delayed 3+ hours, or you're denied boarding, EU261 applies. Compensation is fixed: EUR 250 for flights under 1,500 km, EUR 400 for 1,500 to 3,500 km, and EUR 600 for flights over 3,500 km (which covers most transatlantic routes). United must also provide meals, refreshments, and accommodation for long delays under the duty-of-care provisions. The 'extraordinary circumstances' defense (weather, ATC strikes, political unrest) is available to United but is interpreted narrowly. Denied Boarding (Bumping) Payouts on United
When United involuntarily bumps you (denied boarding against your will because the flight is oversold), DOT rules require the following cash compensation: if United gets you to your destination within 1 hour of your original arrival, no compensation is owed. If the delay is 1 to 2 hours domestically (1 to 4 hours internationally), compensation is 200% of your one-way fare, capped at $775. What United Typically Offers vs. What You're Owed
United's first offer at the gate is almost always a travel credit or MileagePlus miles, not cash. The credit amount is often modest relative to what the law provides. Here is a comparison for a common scenario (domestic cancellation, 4-hour delay to destination):
