Vueling EU261 Compensation: A Deep Dive Into Your Rights on Spain's Largest LCC

Vueling is Spain's largest low-cost carrier and part of the IAG group. EU261 applies, but Vueling has a reputation for initial claim denials. This deep dive covers eligibility, amounts, filing, and escalation.

Does EU261 Apply to Vueling?

Yes. Vueling Airlines S.A. is a Spanish carrier headquartered in El Prat de Llobregat, near Barcelona. As an EU carrier, EU261/2004 applies to all Vueling flights departing from EU airports and to Vueling flights arriving at EU airports from non-EU destinations.

Key fact: Vueling is part of the International Airlines Group (IAG), which also owns British Airways and Iberia. Being part of IAG does not change Vueling's obligations as a separate EU carrier under EU261.

Vueling's Route Network and Claim Tiers

Vueling operates primarily within Europe and to North Africa from its main hubs at Barcelona (BCN) and Madrid (MAD). Most Vueling routes are under 3,500 km, putting them in the 250 or 400 euro compensation tiers.

  • 250 euros: flights under 1,500 km (e.g., Barcelona to Madrid, Paris, London)

  • 400 euros: flights 1,500 km to 3,500 km (e.g., Barcelona to Athens, Casablanca, Copenhagen)

  • 600 euros: flights over 3,500 km (fewer Vueling routes qualify, but some long routes exist)

Vueling does operate some transatlantic routes from Barcelona. If your Vueling flight was on one of these longer routes and arrived 3+ hours late, the 600 euro tier applies.

Vueling and EU261 Claim Denials

Vueling has a reputation for initially denying valid EU261 claims, often citing extraordinary circumstances for delays caused by operational factors like crew availability, aircraft positioning, or technical issues that are within the carrier's control.

Important: Technical faults are generally not extraordinary circumstances under EU261. The ECJ's ruling in Wallentin-Hermann v Alitalia (C-549/07) established that technical problems inherent to normal airline operation do not qualify.

Do not accept a first refusal without requesting the specific extraordinary circumstance in writing. Vueling must explain precisely why the delay fell outside its control and what reasonable measures it took to avoid it.

How to File a Vueling EU261 Claim

File through Vueling's customer service portal or by email to their passenger rights team. Your claim must include:

  • Full booking details and flight number

  • Actual departure and arrival times (compare to scheduled times)

  • A citation of EU261/2004, specifically Article 7 (compensation) and Article 5 (cancellations)

  • Your bank details or preferred payment method

Vueling is required to respond within a reasonable time. In Spain, airlines are expected to respond to EU261 claims within 30 days of submission. If Vueling refuses or does not respond within 8 weeks, escalate to Spain's national enforcement body.

Escalating to Spain's AESA

The Agencia Estatal de Seguridad Aérea (AESA) is Spain's aviation regulator and the national enforcement body for EU261 for flights departing Spanish airports. AESA accepts online complaints and has formal mediation and enforcement powers against airlines.

File at sede.seguridadaerea.gob.es after Vueling has refused or failed to respond. AESA decisions are not directly binding on the airline in the same way a court judgment would be, but AESA can impose fines and its involvement often motivates Vueling to settle.

Escalation path: Vueling refusal or no response within 8 weeks, then AESA complaint, then Spanish civil court (Juzgado de lo Contencioso-Administrativo or civil court for passenger rights claims) if AESA does not resolve it.

Vueling Cancellations and Your Rights

For Vueling flight cancellations, EU261 entitles you to a choice between: a full refund, rebooking on the next available flight, or rebooking at a later date at your convenience. You are also entitled to compensation unless the cancellation was caused by extraordinary circumstances and you were given at least 14 days' notice.

For cancellations within 14 days of departure, the compensation amounts are the same as for delays (250 to 600 euros by distance). Vueling must also provide meals and accommodation if you are stranded overnight.
