Warsaw Chopin Airport (WAW) is Poland's busiest airport and a major hub for LOT Polish Airlines. EU261 applies to all WAW departures, giving passengers rights to fixed cash compensation of up to 600 EUR, care, and rebooking. This deep dive covers every EU261 rule at WAW, how to claim against LOT and other carriers, and how to escalate to the Polish Civil Aviation Office.

EU261 at Warsaw Chopin Airport: The Complete Framework

Warsaw Chopin Airport (WAW) is Poland's primary international gateway and the hub for LOT Polish Airlines (LO). As an EU airport in Poland, every flight departing from WAW is covered by EU Regulation 261/2004 (EU261). This applies to all carriers, whether Polish, European, or non-European. A flight from WAW on Emirates, United, or LOT is equally covered because the departure point is an EU airport.

EU261 at WAW covers: All departing flights from Warsaw Chopin, on any carrier, to any destination. Compensation: 250 to 600 EUR per passenger. Enforcement: Polish Civil Aviation Office (ULC) at ulc.gov.pl.

For the full EU261 regulation text and framework, see EU261 rights. For EU261 information from the European Commission, see transport.ec.europa.eu. For a complete refund strategy alongside EU261 claims, see how to get a refund from your airline.

EU261 Compensation Amounts for WAW Delays

EU261 sets fixed per-passenger compensation based on flight distance (great circle distance between departure and final destination):

  • 250 EUR: Flights up to 1,500 km (e.g., WAW to Amsterdam, WAW to Paris, WAW to Munich, WAW to Vienna).

  • 400 EUR: Flights between 1,500 km and 3,500 km (e.g., WAW to Madrid, WAW to Athens, WAW to Cairo, WAW to Dubai).

  • 600 EUR: Flights over 3,500 km (e.g., WAW to New York, WAW to Chicago, WAW to Beijing, WAW to Cape Town).

The 50% reduction rule: if an airline offers an alternative route that arrives within 2, 3, or 4 hours of the originally scheduled arrival (for short, medium, and long-haul respectively), compensation may be reduced by 50%. Full compensation applies if the alternative arrives outside those windows.

When EU261 Compensation Triggers at WAW

EU261 compensation triggers in three main scenarios:

  • Delay of 3 or more hours at the final destination: If your flight departed WAW on time but encountered delays en route and arrived 3 or more hours late, compensation is owed if no extraordinary circumstances apply.

  • Cancellation: If your WAW departure is cancelled, you are entitled to compensation (plus rebooking or refund) unless notified 14 or more days before departure.

  • Denied boarding: If you were involuntarily bumped at WAW on a confirmed booking where you checked in on time, full compensation applies immediately.

The delay is measured at the final destination, not at WAW. A flight that departs WAW 4 hours late but the delay is at the final destination counts. If you had a connection and the cumulative delay at your final destination is 3 or more hours due to the WAW disruption, compensation is triggered. Use TravelStacks to check your specific situation.

LOT Polish Airlines EU261 Claims: How to File

LOT Polish Airlines is the dominant carrier at WAW. Filing a EU261 claim against LOT:

  1. 1

Visit the LOT customer service portal at lot.com and navigate to the complaints or EU261 compensation section.

  2. 2

Enter your PNR, flight number, and date of travel.

  3. 3

Select 'flight delay,' 'cancellation,' or 'denied boarding' as the disruption type.

  4. 4

State the exact compensation amount you are claiming per EU261 Article 7, based on your route distance.

  5. 5

Attach your boarding pass (or evidence of check-in), booking confirmation, and any written disruption notification from LOT.

  6. 6

Submit and record the case reference number.

  7. 7

LOT should respond within 6 to 8 weeks. If the claim is denied or ignored, escalate to ULC.

LOT's extraordinary circumstances claims: LOT sometimes claims extraordinary circumstances (weather, ATC) for delays that were partly or fully within its control. Challenge any denial that attributes a delay to extraordinary circumstances if the disruption started with a mechanical fault or late inbound aircraft.

EU261 Claims Against Non-LOT Carriers at WAW

WAW handles significant traffic from Ryanair, Wizz Air, Lufthansa, and other carriers. EU261 claims against these carriers from WAW:

  • Ryanair (FR) at WAW: File at Ryanair's EU261 claims portal. Ryanair frequently contests extraordinary circumstances. If denied, escalate to ULC or use ADR.

  • Wizz Air (W6) at WAW: File at Wizz Air's customer portal. Wizz Air uses its own ADR process.

  • Lufthansa (LH) at WAW: File at Lufthansa's customer relations portal. Lufthansa is generally cooperative with valid EU261 claims.

  • EasyJet (U2) at WAW: File at easyJet's disruption claims portal. easyJet UK is subject to UK261 rather than EU261, but easyJet Europe (the EU-licensed entity) operates some WAW routes and is subject to EU261.

Extraordinary Circumstances at Warsaw Chopin

EU261 exempts airlines from compensation in extraordinary circumstances, but the definition is narrow. At WAW, common claims and their EU261 status:

  • Severe weather (fog, ice, storm): Extraordinary. No compensation obligation, but care rights apply.

  • ATC strike or restriction: Extraordinary if it directly caused the delay and the airline took all reasonable measures.

  • Bird strike: Extraordinary in most cases, depending on severity and aircraft damage.

  • Mechanical failure: Generally NOT extraordinary. Most aircraft technical faults are within the airline's operational control.

  • Late inbound aircraft: Generally NOT extraordinary. Airline scheduling failures are not extraordinary circumstances.

  • COVID-related restrictions: EU courts have held that government travel restrictions can be extraordinary circumstances. Post-COVID, most such restrictions have ended.

The European Commission provides guidance on extraordinary circumstances at transport.ec.europa.eu. ULC has issued its own guidance for Polish proceedings. If an airline claims extraordinary circumstances, ask for written documentation supporting the claim.

Escalating to the Polish Civil Aviation Office (ULC)

The Urząd Lotnictwa Cywilnego (ULC) is Poland's designated EU261 enforcement body. ULC can investigate airlines and compel compensation payments.

  1. 1

Escalate to ULC after the airline denies your claim or fails to respond within 8 weeks.

  2. 2

File at the ULC consumer complaints portal at ulc.gov.pl. The portal is available in Polish; use translation tools if needed.

  3. 3

Provide your full name, contact details, flight details, booking reference, a description of the disruption, the airline's response (or silence), and copies of all evidence.

  4. 4

ULC will contact the airline and both parties will have the opportunity to submit evidence.

  5. 5

ULC proceedings typically take 2 to 4 months. A ULC decision is binding.

ADR in Poland: Poland also has approved ADR mechanisms for aviation. Check the ULC website for current approved ADR providers. ADR is often faster than ULC proceedings.

Care Rights at Warsaw Chopin Airport

EU261 Article 9 care rights apply at WAW from the moment a delay or cancellation is announced, regardless of compensation eligibility:

  • Meals and refreshments proportionate to the waiting time.

  • Two free phone calls, emails, or faxes.

  • Hotel accommodation if an overnight stay is required.

  • Transport between WAW and the hotel and return.

If the airline fails to provide care, keep receipts for all out-of-pocket expenses. You can claim reimbursement of reasonable actual costs in addition to fixed compensation. LOT and other carriers at WAW typically distribute meal vouchers at the gate or at airline service desks in the terminal.

Connecting Flights Through WAW: EU261 Coverage

WAW is LOT's connecting hub for Central and Eastern European traffic. EU261 rules for connections:

  • Single booking: If your entire itinerary is on one booking and a WAW connection delay causes you to arrive at your final EU or international destination 3 or more hours late, EU261 compensation applies for the whole journey.

  • Separate bookings: If you booked separately and missed a connection at WAW, the delayed carrier owes EU261 rights only for its segment.

  • Inbound flight to WAW causing a missed WAW departure: If you flew into WAW on an EU261-covered flight that was delayed, causing you to miss your LOT connection, the inbound carrier may owe EU261 compensation for the resulting final destination delay.

Historical Context: EU261 Enforcement in Poland

Poland has been part of the EU since 2004 and adopted EU261 on accession. ULC was designated as the enforcement body from 2004. Over the years, ULC has handled thousands of complaints against LOT, Ryanair, Wizz Air, and other carriers at WAW.

Polish courts have also adjudicated EU261 cases, generally following European Court of Justice precedent. Notable ECJ cases that affect WAW claims include Sturgeon v Condor (establishing the 3-hour delay rule), Nelson v Lufthansa (confirming delays trigger the same rights as cancellations), and Wallentin-Hermann v Alitalia (defining technical faults as not automatically extraordinary circumstances). These cases are as relevant to WAW disputes as to any EU airport.

Expert Tips for WAW EU261 Claims

Practical advice for maximizing EU261 recovery at WAW:

  • Keep your boarding pass and booking confirmation. These are the two essential documents for any EU261 claim.

  • Screenshot the WAW departure board showing the delay at the time it is announced. Airline systems sometimes retroactively alter delay records.

  • If LOT or another carrier offers a voucher instead of cash compensation, decline it. EU261 compensation must be paid in cash, cheque, or bank transfer (or electronic fund transfer with your consent). See the EC guidance at transport.ec.europa.eu.

  • For non-English speakers filing ULC complaints, ULC accepts complaints in Polish. English submissions may also be accepted but Polish is recommended.

  • Use TravelStacks to check EU261 eligibility and submit your claim efficiently.

UK261 After Brexit: WAW Flights to the UK

For flights from WAW to UK airports on EU-licensed carriers:

  • LOT WAW to London Heathrow: The departure from WAW is covered by EU261. The return from London to WAW is covered by UK261 (London is a UK airport).

  • Ryanair WAW to London Stansted: The WAW departure is covered by EU261. The Stansted return is subject to UK261.

  • easyJet WAW to London Gatwick: easyJet operates some WAW routes on its EU-licensed entity (easyJet Europe). Check which entity operated your flight for EU261 vs. UK261 applicability.
