What Delta passengers are entitled to
Under US DOT rules, your rights don’t depend on the reason for the disruption — they’re the law.
Refund
100%
If Delta cancels your flight or delays it significantly and you choose not to travel, DOT requires Delta to refund you to your original payment method — not a voucher or travel credit. This applies regardless of the ticket type.
Expense reimbursement
For controllable delays (weather doesn't count), Delta's Customer Commitment covers meal vouchers and hotel accommodation for overnight delays. Keep all receipts — these are reimbursable even when DOT cash compensation doesn't apply.
Denied boarding (IDB)
Up to $1,950
If Delta involuntarily bumps you from an oversold flight, DOT mandates cash compensation of up to $1,950 depending on your delay to the destination.
EU261 / UK261 may also apply
If your Delta flight departed from an EU or UK airport, EU261 or UK261 entitles you to up to €600 / £520 per passenger for delays of 3+ hours — regardless of the reason, with limited exceptions for extraordinary circumstances.

Delta compensation — frequently asked questions
How long do Delta refunds take?
Delta is required to process refunds within 7 business days for credit and debit card payments, and within 20 calendar days for cash or check purchases. If your refund hasn't arrived after that window, Delta is in violation of DOT rules — and you can file a DOT complaint or let TravelStacks escalate on your behalf.
Can I get compensation for a Delta delay?
Under US DOT rules, Delta is not required to pay fixed cash compensation for delays or cancellations — unlike EU261 or UK261, which mandate up to €600 or £520. However, you are entitled to a full refund if you choose not to travel, plus reimbursement for meals, hotel, and transport for controllable delays. If your Delta flight was departing from or arriving into Europe or the UK, EU261 or UK261 may also apply.
What if Delta offers a voucher instead of a cash refund?
You are not required to accept a voucher. DOT rules require Delta to refund you to the original form of payment for canceled or significantly delayed flights. If Delta offers a travel credit and you'd prefer cash, you can reject the voucher and formally request a refund. TravelStacks can file that request on your behalf.
How far back can I claim for a Delta flight?
DOT refund claims have no fixed statute of limitations, though Delta may require you to request within a reasonable time. If your flight was to or from Europe or the UK, EU261 and UK261 allow claims up to 3–6 years depending on the country. We'll check your specific flight — if the flight number and date are available, it's worth checking.
What is Delta's denied boarding policy?
If Delta involuntarily denies you boarding (bumping) due to an oversold flight, DOT mandates cash compensation of up to $1,950 depending on how long you're delayed reaching your destination. Delta must also rebook you on the next available flight at no extra charge. Voluntary denied boarding (accepting a bump offer) is negotiated separately.
Does EU261 apply to Delta flights?
EU261 applies to Delta flights departing from an EU airport, regardless of destination. It does not apply to Delta flights arriving into the EU from the US. UK261 applies to flights departing from UK airports. If eligible, compensation can be up to €600 or £520 per passenger for delays of 3 hours or more at the destination.
