JFK Flight Delays: Your Rights and How to Get Compensated

JFK is one of the busiest international airports in the US and a major gateway for transatlantic flights. When your flight at JFK is delayed or cancelled, both DOT and EU261 rules may apply. Here is what you are owed based on your specific route.

JFK: Where Two Sets of Rules Meet

JFK Airport handles millions of international passengers each year, with heavy transatlantic service from European carriers like British Airways, Lufthansa, Air France, and others. This makes JFK one of the few US airports where both DOT rules and EU261 frequently apply to the same passengers.

EU261 applies to JFK flights operated by EU carriers. A Lufthansa flight from JFK to Frankfurt is covered by EU261 because Lufthansa is an EU carrier. A Delta flight on the same route is not. Check which airline actually operates your flight.

Domestic JFK Delays

For domestic flights from JFK (Delta Shuttle, JetBlue, and others), DOT refund rules apply. A delay of 3 or more hours or a cancellation entitles you to a full cash refund. JFK's congestion and weather patterns (especially during winter and summer thunderstorm season) cause frequent domestic delays.

International JFK Flights and EU261

Transatlantic flights arriving at JFK from EU airports on EU carriers are covered by EU261. Flights departing JFK to EU airports on EU carriers are also covered (because EU carriers are covered on all their flights). This means EU261 compensation of up to €600 per person may be available for JFK international delays.

Common JFK Delay Causes

  • Air traffic congestion: JFK is one of the most congested airports in the US, leading to ground stops and flow control delays.

  • Weather: Summer thunderstorms and winter nor'easters regularly disrupt JFK operations.

  • Runway closures: JFK periodically closes runways for construction, reducing capacity.

  • International customs backups: Peak arrival times can cause extended taxi-in delays.

Congestion delays are not extraordinary circumstances under EU261. While weather may exempt airlines from EU261 compensation, routine congestion and ATC flow control do not. If your airline blames "ATC restrictions" for a routine congestion delay, push back.

How to Claim

For DOT refunds, contact the airline directly and request a cash refund. For EU261 compensation, file with the operating carrier citing the regulation.
