UK Small Claims Structure

UK small claims UK261 works through different systems depending on jurisdiction:

  • England and Wales: Money Claim Online (MCOL) for claims up to £100,000 with small claims track up to £10,000.

  • Scotland: Simple Procedure for claims up to £5,000, Summary Cause £5,000 to £25,000.

  • Northern Ireland: Small Claims Court for up to £5,000, County Court above.

  • Filing fee: £25 to £125 depending on claim amount in England/Wales. Similar bands in Scotland and NI.

MCOL is the most-used path for UK261 passenger claims. Fully online, no lawyer required, typically 2 to 6 months to judgment.

When to Use Small Claims

Small claims is usually better than CAA when:

  • Airline has denied in writing and you want a binding judgment.

  • ADR is unavailable or has failed.

  • Claim exceeds CAA's practical influence (CAA investigation without binding ruling).

  • You want enforcement teeth: court judgments enable bank levy and bailiff enforcement.

  • Multi-passenger cases: one small claims filing can cover a family or group.

MCOL Process

    Enter defendant details: airline's registered office address.

    Specify claim amount: UK261 compensation plus any consequential damages.

Filing Fees by Claim Amount

  • Up to £300: £25 filing fee.

  • £300 to £500: £35.

  • £1,000 to £1,500: £70.

  • £1,500 to £3,000: £80.

  • £3,000 to £5,000: £115.

  • £5,000 to £10,000: £205 (5 percent of claim amount roughly).

  • Fee waiver: available for low-income filers via Help With Fees (EX160).

The filing fee is usually recoverable as court costs if you win. Airlines are expected to cover reasonable court costs in addition to the claimed amount.

Scotland and Northern Ireland

Scotland and Northern Ireland have separate procedures:

  • Scotland Simple Procedure: for claims up to £5,000. Filing fee £41 to £141. Online filing via scotcourts.gov.uk.

  • Scotland Summary Cause: for £5,000 to £25,000. Similar but more formal.

  • Northern Ireland Small Claims: for up to £5,000. Filing fee £25 to £85.

Outcome and Enforcement

If you win:

  • Default judgment (airline no-response): you win automatically; airline has 28 days to pay.

  • Ruled for you: airline pays within the court's specified window, typically 14 to 28 days.

  • Airline doesn't pay: apply for enforcement (Warrant of Control for bailiff, or bank charge).

  • Costs: filing fee and reasonable expenses are typically awarded on top of the principal amount.
